Insurance Coverage Law

Our firm is widely recognized for its expertise in advising clients in the complexities of insurance coverage.  We undertake matters which range from basic policy disputes to complex factual scenarios and reinsurance issues.   We have successfully litigated coverage cases in the trial courts as well as state and Federal appellate courts.   We are also retained to review a client's circumstances and provide evaluations or opinion letters to guide the client through potential pitfalls and avoid allegations of bad faith.

Some examples of the diverse nature of our coverage cases include:
  • An environmental exposure case involving almost 100 Superfund sites from a multinational chemical company in which the liabilities were estimated at 1/4 billion dollars
  • Multiple insurance coverage disputes involving asbestos personal injury and property damage claims arising at a large Lancaster, Pennsylvania industrial site.
  • A case which was litigated over whether Alaska law would provide for insurance coverage of an $8 million dollar punitive damages award.
  • A case involving whether the carrier which had sold a policy to a large taxicab company with coverage limits below those required by state law was liable under the circumstances for coverage up to the statutorily required limits.
  • A case which litigated the applicability of prior acts coverage for an engineer whose work was involved in a fire, where the work performed and the fire both occurred prior to the coverage being purchased.
Consistent with the firm's philosophy of early intervention to minimize risk to our clients, this department advises clients early on  issues arising from the application and interpretation of insurance policies to ensure the best possible end result.   Contact us at insurance@harvpenn.com for more information.
